B.C. local-hours eligibility
This service is limited to operations that qualify under MVAR 37.28: the driver remains within 160 km of the home terminal, returns there daily, receives at least 10 hours off each day and 10 consecutive hours at the terminal before further on-duty time, and has 24 consecutive hours off in the previous 14 days. Opening history must state the actual on-duty and off-duty hours for each previous day, including work for a previous carrier or another employer. A day may be certified off only when the driver was fully off duty; silence is not treated as off-duty.
Driver-controlled shift clock and safety lock
Signing in does not start on-duty time. The driver must intentionally press Start shift when reporting for duty. Before starting, ClearRoad checks certified opening history, required off-duty periods and the applicable Cycle 1 or Cycle 2 limit. Driver-abstract schedule or review results never block a shift. During a shift, ClearRoad records server timestamps and places the shift off duty when the allowance available at shift start is reached while the app is active. ClearRoad cannot physically stop a vehicle or replace the carrier’s dispatch control and supervision.
Quarterly driver-abstract policy
Each driver’s first abstract is due on the first day of hire. Later due dates recur every three calendar months from that hire date. When an abstract is uploaded, the AI review reports dated entries that occurred during the 12 months ending on the review date. The review records concern dates, a factual summary, or that no concerns were found. It does not approve or reject the abstract and never disciplines, suspends, restricts, blocks dispatch, contacts authorities, or takes any other action against a driver.
Outside local scope
If a local condition fails, the factual record is retained and marked outside_local_scope. The carrier must use its full RODS or certified ELD process. ClearRoad does not generate full RODS, certify an ELD, physically block dispatch, process payroll, or support federal/interprovincial, logging-truck, or oil-well-service rules.
Inspection and supporting documents
The guided shift workflow creates signed pre-trip and post-trip reports containing the vehicle number plate, applicable unit and trailer identifiers, inspection date, the systems listed in MVAR 37.60(2), defects or a no-defect statement, and the authenticated driver signature. An existing inspection report may still be uploaded instead. Fuel, maintenance, repair, load and defect evidence receives a server timestamp and remains linked to the driver and service day. A safety-affecting defect is flagged for immediate carrier review; ClearRoad does not itself certify a repair or authorize driving.

- National Safety Code Carrier Safety Guide — operational guidance for B.C. carriers.
A 36-hour Cycle 1 or 72-hour Cycle 2 reset is optional unless needed to reset or switch a cycle. A driver may instead regain hours as the rolling window advances. Regulatory answers are grounded in the effective source version and display an “as of” date.
AI boundaries
The assistant can explain figures produced by the deterministic rules engine, and the abstract workflow can extract dated concerns within its defined window. AI cannot independently calculate or certify official hours, change driver status, make employment decisions, notify authorities, or alter records. Requests are scoped to the signed-in user’s permitted carrier and driver records, and API-side response storage is disabled.
Privacy and retention
Primary records and supporting files are retained in the hosting provider’s storage for seven years from the service date, with legal holds overriding deletion. The current hosting provider does not currently provide a data-residency guarantee. Hosting, email and AI providers may process limited information as subprocessors. A privacy impact assessment, vendor agreements, incident-response procedures, access testing and backup/export procedures are required before production reliance.
Not legal advice
ClearRoad provides recordkeeping and compliance-support information. It is not legal advice and is not a substitute for review by a qualified B.C. carrier-safety professional.
